▪️When noting down Qur'anic verses, is it necessary to write them down according to the Uthmanic script at all times?▪️

Our Shaykh, Muḥammad ibn Ḥizām -may Allāh preserve him- was asked the following question:

📩 Question:

When noting down Qur'anic verses during classes and when listening to recordings, is it necessary to write them according to the Uthmanic script or is it permissible to write them following the standard spelling rules (Imlā')?

📝 Answer:

It's permissible to write (Qur'anic verses) following the standard rules of Imlā'. What's obligatory is to maintain the Muṣ-ḥaf (copy of the Qur'ān) according to the Uthmanic script; so if you're going to make a copy of the Muṣ-ḥaf, you have to write it according to the Uthmanic script. As for all other books and general note-taking, it's okay to write down Qur'anic verses following the rules of Imlā'.

▪️What happens if a woman delays repaying her missed fasts up until the next Ramaḍhān?▪️

Our Shaykh, Muḥammad ibn Ḥizām -may Allāh preserve him- was asked the following question:

📩 Question:

A woman missed a day from Ramaḍhān and didn't make up for it until the start of the next Ramaḍhān. What is upon her?

📝 Answer:

If she was prevented from making it up due to sickness, weakness, pregnancy or breastfeeding, then there's nothing upon her except to make it up after Ramaḍhān. Allāh says:
{فَعِدَّةࣱ مِّنۡ أَیَّامٍ أُخَرَ}
“...then an equal number of other days...”
[Surah Al-Baqarah 184]
If however she had the ability to make it up but was negligent and delayed up until the next Ramaḍhān then she is sinful for this and she has to repent to Allāh and seek forgiveness. The scholars differed over whether the one who missed fasting out of negligence should feed a poor person on top of making up for the fast. And what is closer to being correct -inshāAllāh- is that she only has to make up for the missed fast. Allāh says:
{فَعِدَّةࣱ مِّنۡ أَیَّامٍ أُخَرَ}
“...then an equal number of other days...”
[Surah Al-Baqarah 184]
This is the opinion of Imām Al-Bukhārī. He has a chapter heading on this in his authentic collection that reads:
'Allāh says: ”...and whoever is ill or on a journey, the same number of days which one did not observe fasts must be made up from other days...,”' without the mention of feeding the poor.

▪️How does a woman go about repaying her missed fasts if she encounters consecutive pregnancies and has to suckle her infant in between that?▪️

Our Shaykh, Muḥammad ibn Ḥizām -may Allāh preserve him- was asked the following question:

📩 Question:

In the situation of a woman who is pregnant during one Ramaḍhān, and in the following Ramaḍhān breastfeeds her newborn child, what is upon her with regards to repaying back her missed fasts?

📝 Answer:

She makes up for these fasts as soon as Allāh gives her the strength to do so. As soon as she is able to, she makes up for them. This debt remains with her until she pays them back, even if that goes on for years. If she finds herself in this same situation for years and the days pile up, and she weakens (with age) and is unable to pay them back or finds great difficulty in doing so then she should feed a poor person for every missed day; as her situation in this case resembles that of the elderly who is unable to fast. If she is able to repay the missed days by distributing them and fasting a day or two each week until she makes up for all of them, she should do so. But if that's too difficult then she feeds a poor person for each missed day.

NOTE:
I (Muḥammad Ibn Aḥmad) asked the Sheikh if feeding the poor is wājib in the above case, to which he responded (paraphrasing): No, it's from the angle of recommendation.


It is reported in Ṣaḥīḥ Muslim from the ḥadīth of Jābir ibn Samurah -raḍhiyallāhu ‘anhu- that the Prophet ﷺ was informed of a burial that took place at night, so he censured them and said:

((إذا كفن أحدكم أخاه فليحسن كفنه))

“If anyone of you is charged with taking care of his brother (after death), let him shroud him well.”

The enemies of Islām (the disbelievers) have no concern for their dead, nor do they dignify their corpses, so it's not permissible to follow their example.

It's incumbent for Muslims to honour their dead. The dead bodies should be disinfected and handed over to the relatives to wash, shroud and pray over them appropriately, so that they are honoured in accordance to what Allāh has prescribed.

So my advise to the Muslim rulers -may Allāh grant them success- is to fear Allāh with respect to the deceased from amongst the Muslims.

And perhaps, this may be a means for the uplifting of this epidemic from them; i.e. honouring their Muslim brothers may be a cause for this epidemic to be uplifted, because Allāh -the Exalted, the Most High gives repayment in accordance to one's deeds; so the one who is good to others, Allāh will be good to him, and whoever treats others badly, Allāh -the Exalted the Most High- may afflict them with something harmful.

So when a person places himself, his partner, or one of his relatives in this position, he would certainly censure this and start dealing with people in a good way. And we ask Allāh to rectify the affair and to guide us to that which He loves and is pleased with. O Allāh, You are free from every imperfection; praise be to You. I testify that there is no true diety except You; I ask Your Pardon and turn to You in repentance.

▪️Advice to the Muslim rulers -may Allāh grant them success- concerning the corpses of those who have died from the epidemic▪️

This is a blessed advice given by our virtuous and blessed Sheikh Muhammad Ibn Hizaam AlBa'daani -may Allah preserve him, protect him and make him a source of benefit for Islam and the Muslims-.

This advice was issued on the first of Shawwaal in the year 1441 A.H.

All Praises belong to Allāh, and peace and blessings be upon the Messenger of Allāh; his family, companions and all his loyal followers. I bear witness that there is no diety worthy of worship except Allāh, alone without any partners, and I bear witness that Muhammad is His servant and Messenger.

To proceed:

Among the affairs that Allah has enjoined upon us is clarifying the truth to the people, as well as advising the leaders of the Muslims and the laymen.

So based on this, we advise the Muslim rulers -may Allah grant them success- to make it mandatory to treat all the deceased Muslims who have fallen prey to this epidemic in a dignified manner and not to allow any harm to come to them.

The believer is noble in the sight of Allāh -the Exalted and Mighty-. [The Prophet ﷺ said:]

((إن دماءكم وأموالكم وأعراضكم عليكم حرام كحرمة يومكم هذا في شهركم هذا في بلدكم هذا))

"Verily your blood, your property and your honour are as sacred and inviolable as the sanctity of this day of yours, in this month of yours and in this town of yours.”

Even if a Muslim dies due to an epidemic, it's still not allowed to handle them the way the disbelievers handle their deceased; leaving them unwashed and prohibitting people from coming together to pray over them, and only allowing one or two people to pray over them, while preventing his relatives from praying over them!! Doing this is impermissible, even if they died due to the epidemic, as they are able to disinfect the corpse. So they should spray some disinfectant on the corpse in order to kill that which is on it from virus and bacteria. After that, they hand the body over to the family so it can be washed, shrouded and buried in a dignified manner.

As for throwing them into [body] bags and leaving them unwashed and perhaps not even allowing more than one or two people to pray over them, then this is ḥarām. In fact, this is a great offence towards the Muslim.

The Prophet ﷺ said:

((كسر عظم الميت ككسره حياً))

“Breaking the bone of a muslim when he is dead is like breaking it when he is alive." 

So the sanctity of a dead Muslim is the same as when he is alive. And the prophet ﷺ highly magnified and emphasised the rights of the believer. During the farewell pilgrimage, he repeatedly reminded with preserving the rights of the Muslims, when he ﷺ said:

((إن دماءكم وأموالكم وأعراضكم عليكم حرام كحرمة يومكم هذا في شهركم هذا في بلدكم هذا))

"Verily your blood, your property and your honour are as sacred and inviolable as the sanctity of this day of yours, in this month of yours and in this town of yours. Verily! I have conveyed this message to you."

Would any of the Muslim rulers like it if they or any of their relatives were treated in this way after death?? Never will they accept this.

The Prophet ﷺ said:

((ما من رجل مسلم يقوم على جنازته أربعون رجلاً لا يشركون بالله شيئاً إلا شفعهم الله فيه))

“If a Muslim dies and forty men -who do not associate anything with Allāh (in worship)- pray over him, Allāh makes them intercede for him.”

[Reported by Muslim from the ḥadīth of ‘Abdullāh ibn ‘Abbās -raḍhiyallāhu ‘anhumā-]

And the Prophet ﷺ said:

((من قامت عليه أمة من الناس يبلغون مائة يصلون عليه إلا غفر له))

"No Muslim dies and has a community of Muslims reaching one hundred pray over him, except that Allāh forgives him.”

And in another wording, he ﷺ said:

((إلا شفعوا فيه))

“except that their intercession for him is accepted.”

Increasing the congregation in the funeral prayer is highly desirable. Hence, the prophet ﷺ censured from burying the dead at night - especially if there isn't a good number to pray over them.

▪️If my parents become ill and request to stay at home rather than be taken to the hospital, should I fulfil their request?▪️

Our Shaykh, Muḥammad ibn Ḥizām -may Allāh preserve him- was asked the following question:

📩 Question:

With the cases of Corona in the UK on the increase, and the subsequent effects on the elderly; (being quarantined from relatives in the hospital and other than that) some parents request from their children in the event of becoming ill that they should not take them to the hospital, but rather to keep them at home; to regain their health or spend their last moments in the company of their loved ones. Is it binding upon the children to fulfill this request despite the hospital possibly being better for the health of the parents, and the chances of being cured greater? Are they sinful if they take them to the hospital? We request a supplication for the elderly Muslims, may Allāh reward you with good.

📝 Answer:

I ask Allāh, the Greatest, Lord of the Great Throne, The Ever-living, The Self-sufficient Sustainer, The possessor of Majesty and Honour to be merciful to the Muslims and to alleviate this pandemic.

I ask Allāh to be merciful to the Muslims, both their young and elderly, and to alleviate this pandemic.

I ask Allāh to be merciful to the Muslims and to alleviate this pandemic.

If there is genuine hope of a cure - by the permission of Allāh -, then they should take them to the hospital. If it is unlikely however that they will benefit, then they should not subject them to humiliation; i.e. possibility of not being buried or prayed upon. So in this case, It is better for them to remain at home. We ask Allāh to be gracious to the Muslims.

📝 Answer:

Yes, it's permissible - so long as the evidences (quoted) are authentic and the merchandise itself conforms to the Sharī'ah. So yes, there's no problem with that.

▪️Ruling on selling cats▪️

Our Shaykh, Muḥammad ibn Ḥizām -may Allāh preserve him- was asked the following question:

📩 Question:

What is the ruling on selling cats?

📝 Answer:

There’s a ḥadīth prohibiting the sale of cats, but it has a hidden defect, and so it is inauthentic; the ḥadīth in question was reported by Muslim, on the authority of Jābir, that the Prophet ﷺ prohibited the selling of cats and dogs.

However, Ma’qil Ibn ‘Ubaydillāh Al-jazariyy (one of the sub-narrators) was faulted, and Imām Aḥmad and others have criticised it, hence the ḥadīth is weak. So taking this into account, it is permissible to sell them, and because they offer various legitimate benefits, such as: eating insects, protection against mice, and so on; there are several legitimate benefits (for keeping cats), so there’s no problem (with selling them).

▪️Ruling on praying in congregation with social distancing measures in place▪️

Our Shaykh, Muḥammad ibn Ḥizām -may Allāh preserve him- was asked the following question:

📩 Question:

The questioner says: What is the ruling on the congregation prayer that is offered while there are gaps in between each member of the congregation - as a precautionary measure to avoid the spread of the so called Coronavirus, since these measures are being forced upon us?

📝 Answer:

All Praises belong to Allāh, and peace and blessings be upon the Messenger of Allāh, his family, his Companions, and everyone that follows his guidance, and we seek Allāh's aid.

To proceed:
 
If the gaps are small, then the congregation is sound and valid, but if the gaps are great, then it is invalid; because the Prophet ﷺ said:

((لا صلاة لمنفرد خلف الصف))

"There is no prayer for the one who prays alone behind the row."

So we recommend that he prays by himself at home and refrain from attending the congregation if the gaps are great.

And with Allāh lies all success.
