Dear Sir/Madam,
I am writing this legal notice to highlight that Officer Jeremy Kuan of the Singapore Police Force (SPF) may be in contempt of the Honourable Court’s directions to take a Conditioned Statement from me, Ng Kai Hoe Raymond (S73***16C), for the purpose of assisting the Court in understanding the cause of Ms. Geno Ong Kay Yong’s death. The relevant Court case number is CI-003506-2024.
The State Coroner, Honourable Adam Makhoda, directed Officer Jeremy Kuan to contact me on 20 November 2024 at 4:30 PM. This direction was communicated to me via email, and I assume the Honourable Court also informed Officer Jeremy Kuan of this directive. In any case, I reached out to Officer Jeremy Kuan on 20 November 2024 at 11:26 PM. He replied on 22 November 2024 at 4:17 PM, confirming his awareness of the Court’s directions.
It is clear that Officer Jeremy Kuan is aware of the Honourable Court’s instructions, as the Court has deemed my Conditioned Statement crucial for the proceedings of CI-003506-2024. On 28 November 2024 at 8:00 AM, I sent a polite email reminder to multiple recipients about these directions.
However, as of now, Officer Jeremy Kuan has made no attempt to take my Conditioned Statement. Publicly available information indicates that Honourable Adam Makhoda is scheduled to disclose his findings on 12 December 2024 regarding CI-003506-2024. Based on these circumstances, I have reasonable grounds to believe that Officer Jeremy Kuan may not intend to comply with the Court’s directions.
As a result, I am compelled to explore legal options to rectify this issue. I remind all involved that, as a potential witness, my primary obligation is to the Honourable Court, not to any other branch of Government.
If Officer Jeremy Kuan fails to contact me to take my Conditioned Statement, in violation of the Court’s directions, I will be compelled to initiate contempt of court proceedings against him.
Depending on the level of complicity within the SPF, I may also initiate contempt of court proceedings against the Singapore Police Force. Similarly, if there is complicity within the Ministry of Home Affairs, I will pursue contempt of court proceedings against the Ministry.
At present, I will formally inform the Honourable Court that its directions have not been complied with.
If the Attorney-General’s Chambers (AGC) does not grant fiat for contempt of court proceedings, I will consider applying for a Judicial Review (where applicable) to compel the AGC to explain to the Honourable Court why fiat was not granted in light of this apparent breach.
To prevent these steps, I urge Officer Jeremy Kuan to contact me promptly to take my Conditioned Statement.
