Fatwa from the Allāmah:

Shaykh Sālih Al-Fawzān

-May Allāh preserve him-

[Q] What’s your view O shaykh on marrying with the intention to divorce?

What’s the legislative ruling regarding that?

[A] This resembles Al-Mut’ah.

Marriage is not with having intention to divorce, rather it’s with having intention to make it last. If it turns out good for him then Alhamdulilah he continues (upon it), and if it doesn’t turn out good then he divorces her.

As for hiding (the intention to) divorce upon making the marriage contract, then this is (causing) harm in right of the woman and right of her guardians, seeing as they married (her to) him for it to be continuous, whilst he only intends for it to be only temporary, this is not permissible.

◾️”Returning back to the scholars” isn’t a phone ringtone!!◾️

In the Name of Allah, Ar-Rahman, Ar-Raheem.

Indeed referring back to the scholars is from our religion, as Allah has encouraged towards this; our Lord, the Exalted and the Most High, said:

(ۚ فَاسْأَلُوا أَهْلَ الذِّكْرِ إِن كُنتُمْ لَا تَعْلَمُونَ بِالْبَيِّنَاتِ وَالزُّبُرِ ۗ وَأَنزَلْنَا إِلَيْكَ الذِّكْرَ لِتُبَيِّنَ لِلنَّاسِ مَا نُزِّلَ إِلَيْهِمْ وَلَعَلَّهُمْ يَتَفَكَّرُونَ)
So ask of those who know the Scripture if you know not. With clear signs and Books (We sent the Messengers).And We have also sent down unto you the reminder (the Quran), that you may explain clearly to men what is sent down to them, and that they may give thought.

And He, the Most High, said:

(وَإِذَا جَاءَهُمْ أَمْرٌ مِّنَ الْأَمْنِ أَوِ الْخَوْفِ أَذَاعُوا بِهِ ۖ وَلَوْ رَدُّوهُ إِلَى الرَّسُولِ وَإِلَىٰ أُولِي الْأَمْرِ مِنْهُمْ لَعَلِمَهُ الَّذِينَ يَسْتَنبِطُونَهُ مِنْهُمْ ۗ وَلَوْلَا فَضْلُ اللَّهِ عَلَيْكُمْ وَرَحْمَتُهُ لَاتَّبَعْتُمُ الشَّيْطَانَ إِلَّا قَلِيلًا)
When there comes to them some matter touching (public) safety or fear, they make it known (among the people), if only they had referred it to the Messenger or to those charged with authority among them, the proper investigators would have understood it from them (directly). Had it not been for the Grace and Mercy of Allah upon you, you would have followed Shaitan (Satan), save a few of you.

And this is well known and firmly established with Ahlus-Sunnah of old and present, the status of the Salafi scholars and the importance of refering to the scholars and seeking their counselling.

Likewise taking the advises and recommendations from them, and treading upon their path, Salafiyyah. A true sincere Salafi doesnt oppose in that, with all praise being to Allah.

However, we see and witness those who make this like a (mere) phone ringtone.

If they're in need of it they embark, and if they (feel they) don't need it, they change it with something else. Hence why we hear them tone (towards) the scholars, as well as not preceding and referring to the scholars, nor taking advise from the scholars.

Then when the truth manifests and they see the scholars are not with them in their rank, they change this tone to a different tone:

“We are men, and they are men!", “We are not obliged!”, “We are not blind followers!”.

And perhaps they might also delete introductions and praises of scholars from their writings - as a response to the advise and councel of the scholars to them - (in saying) "us and the scholars will all stand infront of Allah" and “the scholars were not just to us” and "refering and forwarding to the scholars and returning to them in trying to solve issues is an innovation and something newly introduced!" And "the scholars listen to trouble makers and support them!"

As for the Salafis, then they're in one state with the Salafi scholars, with all praise being to Allah. They take their advises and directions, and they refer to them during times of turmoil and peace. They're councelled by them and benefit from what they write and what they say and what they spread. They embark with them upon one path; Salafiyyah, and all praise is to Allah.

Therefore, if you see people coming with this type of tone then be aware of them, and know that they are not with the scholars in truth and reality. Furthermore, the likes of these are from those who seek chaos between the Salafis, and that this tone is to deceive the poorly and the weak of souls, so they can capture and play about with them.

So take heed, and Allah is the Granter of success.

What is the sign of a Sunnī?!

Imām Al-Ājūrī in his unique special book 'Ash-Sharī'ah' (2058) said: Abu Ubayd Alī bin Al-Hussein bin Harb Al-Qādhī informed us, he said Abu As-Sukain Zakariyyah bin Yahyā narrated to us, he said i heard Abu Bakr bin Ayyāsh, and a man said to him: "O Abā Bakr, who is a Sunnī?, so he said: "A Sunnī is the one whom when desires are mentioned, he doesn't become angry for the sake of any of it."
[Reported by Lālikā'ī in his 'Usūl' (48) via Abī 'Ubayd, but with him 'become fanatical' instead of 'become angry'.]

It is a Hasan narration, good.

Abu As-Sukain Zakariyyah bin Yahyā was declared trustworthy by Al-Khatīb and Ibn Hibbān, and Dārqutnī declared him weak, and Al-Hāfith said Sadūq with some weakness in him.

It is benefitted from this:
A Sunnī rejoicing at the discrediting of the people of desires and innovation and the people of false opinions, and not getting angry at their mentioning and warning against them and their falsehood.

May Allāh not increase them or make their dwellings close.

◾️Excerpt from page 32-33:

The Salaf-Us-Saalih, may Allah be pleased with them, due to the severity of their veneration of the Sunnah, and their despising of innovation and its people, would consider giving Salaam to the people of Innovations great sins which they feared that Allah would take them account for.

This is one of the Imams of the Salaf from the Taabi'is, and he is Suleymaan bin Tarkhaan At-Tiymi, may Allah have mercy upon him.

Sa'id bin 'Aamir said:

Suleymaan At-Tiymi fell ill and he cried severely, I said to him:

What made you cry? Is it due to dying?

He said:

No, I passed by a Qadari and I gave him Salaam, I fear that my Lord, the Mighty and Majestic, will take me to account for it.

End of speech.

Reported by Abu Nu'aym in "Al-Hilyah" (32/3), and Ibn-Ul-Jawzi in "Talbees Iblees" (13,14).

Ibn ‘Uthaymeen

-May Allah have mercy on him-

Whoever prostrates (makes Sujood) and lifts one of their leg (off the ground) whilst being in Sujood, then verily they nullify their prayer as this leaving off a pillar from its pillars, and whoever leaves off a pillar from the pillars of prayer, his prayer becomes nullified. Similarly if he were to lift his hand whilst in Sujood then that also nullifies his prayer.

📒 *Commentary of our Shaykh Abī Hamzah Hasan Bā Shu'ayb upon the apology of Ibn Hizām*

🍁 Our Shaykh *Abu Hamzah Hasan Bā Shu'ayb may Allāh preserve him* was asked concerning the apology of Ibn Hizām

📒 *So our Shaykh answered may Allāh preserve him*

🍁 *"Ibn Hizām didn't ill treat Shaykh Yahya in his deletion of the introduction of Shaykh Yahya*

*But verily he ill treated himself by
distancing himself from the Tazkiyyah (recommendation) for him and his book.*

*So his apology to the Shaykh and his seeking pardon from him and overlooking is not in its proper place and Allāh knows best.*

*Verily the correct (path to take) is to repent to Allāh from his shady antics which suggests a type of challenging and carelessness and lack of wisdom and manners, and aid is sought with Allāh"*

Lā ilāha illa Allāh!

Al-Fākihī reported in 'Akhbār Makkah' (1029), with an authentic chain on the authority of Ibn 'Uyaiynah may Allāh have mercy on him:

"Amr bin Ubayd used to pray Fajr with the wudhū of Ishā in Makkah!"

Abu Abdillāh Adh-Dhīfānī may Allāh rectify his private affairs:

🚫"Do not become deceived by the acts of worship of anyone or his exertion, until he traverses the Salafī way of life, and his entering and exiting is with Ahlus-Sunnah, and his association and aiding and his Bitānah (advisors, consultants, protectors, helpers, friends, etc.) are righteous Sunnī Salafīs.

For this Amr bin 'Ubaid the filthy Qadarī (a follower of the Qadariyyah), Jahmī (a follower of the Jahmiyyah) heretic used to pray Fajr with the wudhū of 'Ishā, we ask Allāh for Salāmah and Āfiyah (safety from every affliction) and we seek his refuge from being forsaken.

Likewise preserving his eyes and lowering them from what Allah has prohibited of trialling images, images of which trial a person through the screens and satellite channel's, which display nude women or that which resembles nudity.

Upon him is to preserve his eyes from what damages his fast. So fear Allah O slaves of Allah and preserve your fasts from all that weakens it and corrupts it.

يَا أَيُّهَا الَّذِينَ آمَنُوا كُتِبَ عَلَيْكُمْ الصِّيَامُ كَمَا كُتِبَ عَلَى الَّذِينَ مِنْ قَبْلِكُمْ لَعَلَّكُمْ تَتَّقُونَ* أَيَّاماً مَعْدُودَاتٍ فَمَنْ كَانَ مِنْكُمْ مَرِيضاً أَوْ عَلَى سَفَرٍ فَعِدَّةٌ مِنْ أَيَّامٍ أُخَرَ وَعَلَى الَّذِينَ يُطِيقُونَهُ فِدْيَةٌ طَعَامُ مِسْكِينٍ فَمَنْ تَطَوَّعَ خَيْراً فَهُوَ خَيْرٌ لَهُ وَأَنْ تَصُومُوا خَيْرٌ لَكُمْ إِنْ كُنتُمْ تَعْلَمُونَ* شَهْرُ رَمَضَانَ الَّذِي أُنزِلَ فِيهِ الْقُرْآنُ هُدًى لِلنَّاسِ وَبَيِّنَاتٍ مِنْ الْهُدَى وَالْفُرْقَانِ فَمَنْ شَهِدَ مِنْكُمْ الشَّهْرَ فَلْيَصُمْهُ وَمَنْ كَانَ مَرِيضاً أَوْ عَلَى سَفَرٍ فَعِدَّةٌ مِنْ أَيَّامٍ أُخَرَ يُرِيدُ اللَّهُ بِكُمْ الْيُسْرَ وَلا يُرِيدُ بِكُمْ الْعُسْرَ وَلِتُكْمِلُوا الْعِدَّةَ وَلِتُكَبِّرُوا اللَّهَ عَلَى مَا هَدَاكُمْ وَلَعَلَّكُمْ تَشْكُرُونَ
O you who believe! Observing As-Saum (the fasting) is prescribed for you as it was prescribed for those before you, that you may become Al-Muttaqun (the pious).

[Observing Saum (fasts)] for a fixed number of days, but if any of you is ill or on a journey, the same number (should be made up) from other days. And as for those who can fast with difficulty, (e.g. an old man, etc.), they have (a choice either to fast or) to feed a Miskin (poor person) (for every day). But whoever does good of his own accord, it is better for him. And that you fast, it is better for you if only you know.

The month of Ramadan in which was revealed the Quran, a guidance for mankind and clear proofs for the guidance and the criterion (between right and wrong). So whoever of you sights the month he must observe Saum (fasts) that month, and whoever is ill or on a journey, the same number [of days which one did not observe Saum (fasts) must be made up] from other days.

Allah intends for you ease, and He does not want to make things difficult for you. (He wants that you) must complete the same number (of days), and that you must magnify Allah [i.e. to say Takbir (Allahu-Akbar; Allah is the Most Great) on seeing the crescent of the months of Ramadan and Shawwal] for having guided you so that you may be grateful to Him.

THE SECOND KHUTBAH

All praise is for Allah for His favour and good, I thank Him for his success and bestowing of blessings. I testify that none has the right of worship except Allah alone without partners. And I testify that Muhammed is His slave and Messenger, may the Salat and much Salam of Allah be upon him and upon his family and companions.

As for what proceeds O slaves of Allah, fear Allah the Most High!

And from the things which also break the fast is what’s used to cleanse the kidney, or what’s used to cleanse the abdomen, from Mahaleel that enters into the mouth and withdrawn from it, this also breaks the fast.

Likewise also the fasting person is to refrain from backbiting, spreading tales, swearing, insults and lying speech. He’s to preserve his tongue from all what damages his fast.

Fasting is not just mere leaving off food, drink and the permissible affairs, rather alongside that is to leave off the prohibited matters which are required to be left off at all times anyway, but especially more so in the right of the fasting person as this damages his fast and decreases his reward or departs his good deeds until it becomes that his only share from fasting is only attaining hunger and thirst; without him getting a reward for it due to him not preserving his tongue from these matters.

Likewise he’s to protect his hearing from listening to music and songs, as well as not to listen to backbiting and gossip, and nor to anything that will distract him from the remembrance of Allah the Mighty and Majestic, from what’s broadcasted and spread through media platforms. Such as lowly, ridiculing television series’s and entertainment, so not to waste his time with it and nullify his fast due to it as his sinful by doing that.


(من نسي وهو صائم فأكل أو شرب فليتم صومه فإنما أطعمه الله وسقاه)
"Whoever forgets that he is fasting, and eats or drinks is to complete his fast, as it was Allah who fed him and gave him something to drink."


And from that is taking medication which the fasting person swallows or is injected through the rectum; which enters the abdomen, such as pills, liquids, and medicinal I.V. that enter ones abdomen, then indeed doing so breaks ones fast.

Similarly, injections that nourish breaks the fast because it falls under the meaning of food and drink. The same also for injections that’s taken through the veins because it mixes with blood and precedes to the body; this also breaks the fast. As for injections that’s taken under the skin or muscle then this doesn’t affect the fast.

And likewise among the things which break the fast is what’s extracted from the stomach, such as vomiting through the mouth whereby the fasting person vomits what’s in his stomach through the mouth. Thus, if he vomits (deliberately) then he breaks his fast, as for if he’s overcome by the vomit without choice then this doesn’t effect his fast.

Likewise from the invalidators of the fast is extraction of semen by way of sexual intercourse, or by way of the secret sin (masturbation), or by way of looking, repeatedly looking, continuously looking at women. So because of that it causes him to ejaculate due to it being a type of intercourse that causes the emitting of desires caused by the person himself, ejaculation caused by himself, thus his fast breaks because of it, seeing as from what is (also meant to) be fasted from is desires.

Allah the Most High said in the Hadith Qudsi regarding the fasting person:

(يدع شهوته وطعامه وشرابه من أجلي)
“He left off his desires, food, and drink for my sake”

So just as he leaves off food and drink, then likewise he leaves off the emitting of desires as this is from the things which break the fast.

Likewise, from the invalidators of the fast is Hijāma, which is withdrawing blood for the purpose of treatment, as this weakens the fasting person and removes his strength.

The Prophet ﷺ said:

(أفطر الحاجم والمحجوم)
“The performer of Hijāma and the one who Hijāma is being performed on both break their fast”.

And similar to Hijāma is: medically extracting blood to assist a sick person or to donate it; verily this breaks the fast because it resembles Hijāma in withdrawing a lot of blood. As for small amount of blood like what’s withdrawn for tests whilst it’s only a little, then this doesn’t affect the fast.

Also, from the things which break the fast is what women undergo of menstruation, as this also weakens the woman, it weakens her strength, that is why Allah prevented them from fasting and obligated expiation for it.

(فَعِدَّةٌ مِنْ أَيَّامٍ أُخَرَ)
The same number (should be made up) from other days

And as for Istihātha (intermenstrual bleeding), which is a bleeding which occurs at other than it’s expected time, then this doesn’t effect the fast, therefore the one experiencing this is to fast because she takes the ruling one who is pure. Likewise if a person was to get wounded causing blood to flow from him, then it also doesn’t effect his fast because it was without his choice.

Therefore preserve your fasts from all that breaks it, May Allah have mercy upon you.

Likewise, from what is obligatory upon the fasting person is to follow through his intention like what we have mentioned. Because if the fasting person was to intend to break his fast he would invalidate it even if he didn’t consume anything, if he intends to break an obligatory fast then he would invalidate his fast due to cutting off the intention. Preserve your fasts from what corrupts it and what makes it deficient.


THE FIRST KHUTBA

All praise be to Allah the Lord of the worlds, He made the fasting of Ramadhan one of the pillars of Islām. And I testify none has the right of worship except Allah alone without no partners, He called out to His slave and said:

(يَا أَيُّهَا الَّذِينَ آمَنُوا كُتِبَ عَلَيْكُمُ الصِّيَامُ)
O you who believe! Observing As-Saum (the fasting) is prescribed for you

And I testify that Muhammed is His slave and Messenger, the best of those who prayed and fasted, May the Salat and much Salam of Allah be upon him and upon his family, the pious and the noble.

As for what proceeds:

O mankind, fear Allah the Most High and thank Him over the blessing of Islām. Verily Allah the Glorious and Most High prescribed the fasting of Ramadhan upon this Ummah and made it one of the pillars of Islām.

The fasting of Ramadhan is obligatory upon every muslim that’s reached puberty and of sound intellect, from the first of the month to the last of it.

(فَمَن شَهِدَ مِنكُمُ الشَّهْرَ فَلْيَصُمْهُ)
So whoever of you sights the month he must observe Saum (fasting).


The people are in different circumstances during the month of Ramadhan. What’s correct is that the resident; it’s upon him to fast and to do so every day. As for the sick who fasting is difficult for; or who are required not to fast, then they’re not to fast but to expiate it at other days.

And likewise the traveller who shortening has been made permissible for; the one who covers a journey to the distance of 80 kilometres and more, then he’s (permitted) not to fast but to expiate it at other days, due to His statement the Most High:

(فَمَن كَانَ مِنكُم مَّرِيضًا أَوْ عَلَىٰ سَفَرٍ فَعِدَّةٌ مِّنْ أَيَّامٍ أُخَرَ)
but if any of you is ill or on a journey, the same number (should be made up) from other days.


And as for the one who isn’t able to endure fasting due to old age or growing old or a chronic sickness preventing him from fasting, likewise being incapable to repay the fast in the future, then this one is to feed a poor person for every day (they don’t fast).

The Most High said:

(ۚ وَعَلَى الَّذِينَ يُطِيقُونَهُ فِدْيَةٌ طَعَامُ مِسْكِينٍ)
And as for those who can fast with difficulty, (e.g. an old man, etc.), they have (a choice either to fast or) to feed a Miskin (poor person) (for every day).


So these are the circumstances of the people relating to fasting.

And the meaning of fasting linguistically is:

(الإمساك)
To withhold.

As for legislatively then fasting it is:

To withhold with the intention to abstain from what breaks the fast, physically and by meaning, from the rising of the second Fajr until the setting of the sun.

The Most High said:

(وَكُلُوا وَاشْرَبُوا حَتَّى يَتَبَيَّنَ لَكُمْ الْخَيْطُ الأَبْيَضُ مِنْ الْخَيْطِ الأَسْوَدِ مِنْ الْفَجْرِ ثُمَّ أَتِمُّوا الصِّيَامَ إِلَى اللَّيْلِ)
Eat and drink until the white thread (light) of dawn appears to you distinct from the black thread (darkness of night), then complete your Saum (fast) till the nightfall.


Intention (to fast) is required throughout the whole day from Fajr until the setting of the sun, the intention remains with him always, due to his statement ﷺ:

(لا صيام لمن لم يبيت النية من الليل)
“There’s no fast for he who doesn’t form his intention from the night (before)”

And in another narration:

(لمن لم يُجمع النية قبل طلوع الفجر)
“For he who doesn’t gather the intention before the emerging of Fajr”


So, having intention for fasting is a must. It’s such that if he was to refrain from food, and drink, and what invalidates the fast without having intention, then he would not be legislatively labelled as someone who is fasting.

And know, may Allah have mercy upon you, that fasting has (things) that invalidate it whereby it’s obligatory upon the fasting person to abstain from.

Firstly:

What enters the stomach via whatever passage it may be, then the one fasting breaks his fast, such as eating and drinking deliberately.

As for the one who forgetfully eats or drinks, then his fast remains intact and he is excused, due to the statement of the Prophet ﷺ:


مفسدات الصيام

“CORRUPTERS OF THE FAST”

The question has repeated to our Shaykh Yahyā bin Alī Al-Hajūri may Allāh preserve him concerning the issue with the brothers in Ibb.

🔊So he said: "Verily if they are pleased with settling the issue, then verily their brothers will hasten towards that inshāAllāh; and he has repeated many a time that the affairs of Da'wah and solving its issues concerns everyone, and whoever is not pleased with solving it legislatively then his rejection is a mistake and he will bare its burden."

Allāh said:

(قُل لَّن يُصِيبَنَآ إِلَّا مَا كَتَبَ ٱللَّهُ لَنَا)

Qul: "Lan yuseebanaa illaa maa katabAllaahu lanaa"

Say: "Nothing shall ever happen to us except what Allah has ordained for us."
[At-Tawbah, 51]

Ibn Bāz may Allāh have mercy on him said:

"He expressed with His statement 'Lanā' (لنا ) - for us and He didn't say 'Alaynā' (علينا ) - against us, to bring to our attention that whatever happens to us is considered a blessing, not a punishment."

The first print ~ "We thank our Shaykh Yahya, the Trustworthy Advisor"...to the end of it, and in the second print he deletes it. This is an affair that Ahlus-Sunnah seek protection with Allah from, O Shaykh Muhammad, and aid is sought with Allāh.

This is not due to fanaticism for the Shaykh, nor is it binding for a person that he doesn't author a book except with an introduction of the Shaykh, No!

But something that was there before, and something that became widespread and was from the means of the spreading of the book is the introduction of the Shaykh. So why was it deleted after that?

So it is feared that these actions will harm Shaykh Muhammad and his Da'wah and his beloved ones and students will depart from him.

So we advise him with the fear of Allāh and to look at those who may have an impact on him from those who will make him hate the Da'wah of Salafiyyah, the Da'wah of Ahlus-Sunnah."

And aid is sought with Allāh

📗💡Illuminating excerpt from the commentary of Shaykh Fath Al-Qadasī, may Allāh preserve him on Muhammad bin Hizām deleting the introduction of Shaykh Yahya on the new print of his book 'The Book of Fasting' along with his previous praise and thanks of the Shaykh.

🎙"Concerning the new print of the 'Book of Fasting' by Shaykh Muhammad bin Hizām may Allāh grant him success, and that the introduction of our Shaykh Yahya may Allāh preserve him has been deleted from it along with what it contained of thanks and praise of him.

This is a strange, amazing, doubtful affair! What harm would it have done to the book to leave the introduction of Shaykh Yahya on it. Perhaps it was from the means of the spreading the book that Shaykh Yahya gave an introduction to it. Perhaps one of them went with his book and insisted to the Shaykh to give an introduction for it, and reiterated to him in order for it to be accepted by the people. Or in order for the people to put their trust in it. Then when the book got spread, he deletes the introduction. This is an amazing affair!

This action is not befitting for a student of knowledge let alone a Shaykh. So the reality is this action has hurt us. What is strange is that this action is not from a day or two or a week or two ago, verily the introduction of this book was in the month of Safr when he put it forward for printing.

This means it was approximately six months ago, and before a month or two Shaykh Muhammad says I have nothing in my heart for the Shaykh and he says to some of those that met him that he doesn't intend ill treatment to the Shaykh, to the rest of his speech.

This is from a month, or a month and a half ago, and the deletion of the introduction of the Shaykh is from six months ago. The reality is that there is something! We hope from Allāh that it is the contrary to what we suspect. And there is no clear excuse, or accepted excuse from Shaykh Muhammad to his deletion of the introduction of Shaykh Yahya.

If it is said like some of his students said we fear he may receive some pressure from the Houthis if its spread with the introduction of the Shaykh.

We say: Six months ago, or from years ago, until today the book remained available in the bookstores with the introduction of the Shaykh and it hasn't been met by harm from anyone. But rather it has increased in weight on the scales with Ahlus-Sunnah. This is an affair.

So if one says he added issues related to Zakāh ul-Fitr and the two Ēids, and this the Shaykh did not come accross or give an introduction based on it.

The answer is, what is the harm in the introduction of the Shaykh remaining on the 'Book of Fasting'? Because it's the foundation and the majority of the book. And those additional issues are on a small number of pages. So the foundation which the Shaykh gave an introduction for remains upon what it is upon. Then if it is a must because of the additions and the Shaykh did not give an introduction for them, then it is between two affairs:

▪️It is possible to write in the beginning of the book that the introduction for the 'Book of Fasting' was given by Abu Abdirrahmān Yahyā bin Alī Al-Hajūri.

▪️ Or it is possible if we were to agree for the sake of argument that the introduction was to be deleted considering that he had made additions to the book, then what about the deleting of the praises to the Shaykh and his thanks to him in the beginning of the book?
