Former UN Advisor and Interest of Justice place US Government on notice for IHR amendments at World Health Assembly #75

The global advocacy campaign against proposed amendments to the International Health Regulations 2005, is increasing in momentum.

Thirteen core amendments are believed to violate World Health Organisation standards of necessity, proportionality and reasonableness. This point was made yesterday by various individuals and organisations, including World Council for Health partner, and Law and Activism Committee member, Interest of Justice.

Costa Rica based civil rights advocacy group Interest of Justice found out the day before Friday the 13th about an opportunity to make representations on amendments to the IHR, directly to the US Department of Health and Human Services, who proposed these amendments. I wrote about this opportunity and the implications of the IHR amendments, published on TrialSite News this week.

Their representation included the following assertion, which has lead to an extension of the timeframe to participate:

"Third, in regard to implementation of the international health regulations, people have the right to participate in the design, implementation and approval of all health policy but are clearly excluded in the short notice which denies due process. Many thousands of marginalized primary stakeholders believe the proposed IHR amendments must be withdrawn for lack of substantiation of the necessity, proportionality and reasonableness pending time for due process, participation and legal actions."

Also this week, Govinda Tidball, former United Nations advisor on its World Food Programme, currently director of a private entity called The Health Ministry, wrote a notice to WHO Director General Tedros Adhenom Ghebreyesus, and other parties.

The letter, a cease and desist with notice of liability, highlights constitutional rights and the UN Declaration on Human Rights. Of particular interest is the paragraph relate to diplomatic immunity: "The Convention on the Privileges and Immunities of the Specialized Agencies is categorically rejected."

"That all participating members of the upcoming 75th Annual World Health Assembly are hereby personally liable as a signatory for any resulting infringements upon the private domain or the sovereign rights of any member of the Ministry of Health or its partners. Liability extends to any authorizing body or nation state that recognizes the action of their representative. Absent a prompt resolution to this matter, any infringement that is ratified is now the personal responsibility of the participating parties in the 75th Annual World Health Assembly."

At this week-long WHA meeting, national representatives of “countries agree to resolutions, adopt action plans, supervise finances, review and approve the proposed budgets, discuss key public health issues, and determine the policies of the organization.”

The WHA 75 agenda for 22 - 28 May, which is not widely available and translated into hundreds of languages, is available here.

World Health Assembly #75 to vote on sweeping decisions for health and sovereignty

No other country besides the US, which proposed controversial amendments to the International Health Regulations; created a public opportunity to engage on the World Health Assembly 75 agenda.

This lack of participation could lead to a demand for member states to withdraw from the WHO, before November 2022's deadline to reject the IHR amendments.
